Synopsis

This paper presents a comprehensive analysis of the ethical aspects of mediation as a conflict
resolution process, emphasizing its transformative potential in modern society. Mediation represents
an alternative to traditional court proceedings, enabling conflicting parties to find their own solutions
based on their actual needs and interests. The paper examines the fundamental ethical principles of
mediation – voluntariness, impartiality, confidentiality, and responsibility – and analyzes specific ethical
dilemmas that mediators face in practice. It also addresses the professional ethical competencies of
mediators, including empathy, critical thinking, self-awareness, and emotional intelligence. The paper
emphasizes the importance of supervision, continuous education, and multidisciplinary cooperation in
the development of mediation as a professional activity. Based on an analysis of the state of mediation
in Slovakia, specific recommendations for practice are formulated, including changes to the legal status of mediators, improved accessibility of mediation services for all segments of society, strengthened
cooperation between state institutions and mediators, increased public awareness of mediation, and the introduction of mandatory ethical training for mediators. The paper stresses that ethics is not merely a set of rules – it is a dynamic process that requires constant reflection and adaptation to new situations. Only in this way can mediation fulfill its potential as a tool for conflict transformation and contribute to building a more just and empathetic society.
